shutterstock_40722481A Nova Scotia human rights hearing heard about the spotty time and attendance record of woman who claims a racially charged atmosphere forced her to quit her job.

Lawyers for Leon’s furniture store in Dartmouth, N.S. pushed back during Wednesday night’s hearing, challenging the credibility of Garnetta Cromwell.

Cromwell worked at the Leon’s store in Dartmouth from 2004 to 2008. Cromwell, who is black, claims she suffered racial discrimination at work and quit as a result.

Tammy Bishop, manager of Leon’s, spoke at the hearing Wednesday night and Thursday afternoon. The company’s lawyer turned to Bishop to help discredit the work history of Cromwell.

For several hours, the human rights hearing heard about how Cromwell would not come to work for weeks at a time, resulting in a sluggish sales record. Because of that, Cromwell had her three month probation extended to nine months.

“They’re just trying to say that my work wasn’t a priority to me, and that’s not true at all,” she said.

Cromwell said that she was treated differently by Leon’s and some of its employees. She said they used a stern application of the company’s policies because she is black.

On Thursday, Bishop clarified that Cromwell took approved sick days and bereavement leave because of deaths in her family.

Cromwell’s performance reviews ‘good’

Lawyer Lisa Teryl, representing the N.S. Human Rights Commission, said Cromwell’s performance reviews rated her as “good” and “satisfactory” in all areas, including punctuality.

“Garnetta Cromwell has given earlier evidence that she felt unfairly treated by her supervisor. So one of the questions that was put to this witness is the legitimate expectations of an employee in terms of understanding what their discipline would likely be if there’s an infraction, and whether there’s a consistency and follow through on that.”

Teryl also asked Bishop if she knew about a romantic relationship between Cromwell and area manager Dave McLeod.

Cromwell had testified she told Bishop about it.

But on Thursday, Bishop said that conversation never happened.

“I think it’s important to explore all the possible motivations,” said Teryl. “If there’s a perception that a manager is responding in an unfair way, is there something that might be motivating a manager to feel like they might need to be more strict?”

Fingerprint clocking in machines have been  introduced onto the London Underground, in an attempt to stop the cleaners cleaning up on pay day. Their employers seem to be suspicious that the  hours claimed may not be 100% legitimate.

london-underground-logoCleaners working on the London Underground will resort to industrial action this week in protest against the introduction of a controversial biometric clocking system.

Starting at just after midnight on Thursday morning, “up to 300 cleaners” will join in the action by refusing to scan their fingerprints every time they clock on for work, said the union. Their decision will set the workers on a collision course with ISS, the Danish firm which employs them.

 According to the RMT union, 98 per cent of the 103 staffers who responded to the ballot voted in favour of the plans, which stopped short of calling for a full-on strike.

Bob Crow, RMT general secretary, said: “Our tube cleaning members have been urged to stand firm and follow the call by the union to take industrial action short of a strike by refusing to use any biometric/fingerprint technology to book on for duty. We believe this technology infringes on staff civil liberties and the overwhelming vote in favour of action shows our members’ strength of feeling on this issue.

“Strong union organisation in the workplace is the key to preventing this unacceptable method of booking on and RMT will continue to build our ‘Thumbs Down to Fingerprinting’ campaign.”

The union is vague on exactly why biometric fingerprinting is a bad idea. When The Register contacted the RMT, a spokesperson told us staff felt “brutalised” by the system, which made them feel like “slabs of meat”.

The union said it represented between 200 and 300 cleaners, and said that ISS had “bulldozed” the biometric system into use, against the wishes of its staff.

RMT also suggested the fingerprint-based sign-in system infringed the cleaners’ “dignity”. The previous clocking-on method involved an automated phone line and a sheet of paper.

The technology infringed their rights, the union added. The cleaners – who are employed by Danish firm ISS UK – will continue to sign in manually and by phone. “We believe this technology infringes on staff civil liberties and the overwhelming vote in favour of action shows our members’ strength of feeling on this issue,” said Bob Crow, RMT’s general secretary. But Adam Wurf, communications director for ISS UK told the BBC: “With this technology we will be able to guarantee that the member of staff is who they say they are.

“We don’t think this is draconian or an infringement of civil liberties; it’s about making sure we have the right people – verified and trained – in the right place at the right time.”

We explained to Stephen that it was just another example of Unionised interference and over reaction to a harmless use of biometric technology to ensure “fair play” to both sides, the employee and the employer.

The Union is justifying its own existence by stirring up trouble on a topic that is almost guaranteed to get a an overexcited overreaction when presented as an infringement of your human rights.  The Union knows the introduction of a fingerprint clocking on system makes sense, they just want to feel needed by their members and are blatantly playing the “your rights are being infringed card, were here to protect you against this sort of thing”.  The Union should be ashamed of themselves.

shutterstock_67720723STAMFORD — Police arrested a long-time schools custodian for leaving his post while he was clocked in at work earlier this year.

Andrew Shavers, 65, of 1 Southfield Ave., was charged with second-degree larceny for defrauding a public entity, and was released after posting a $15,000 court appearance bond. He is scheduled to be arraigned on the charges at the Stamford courthouse Aug. 15.

Police declined to comment on the case, saying that the city’s law department put a “gag order” on releasing any particulars of the case.

The mayor’s office had scheduled a press conference for Thursday afternoon “to discuss two independent, serious personnel issues,” but later postponed the meeting indefinitely. Details of the second personnel issue have not yet been released.

Shavers, is a 42-year city employee at the top of his pay scale and has an annual base salary of $65,000. He took in $91,000 with overtime and other benefits last year.

Shavers vehemently denied the charge, saying that someone is trying to get rid of him.

He said police explained after picking him up at work at  Rippowam Middle School

Thursday morning that someone at city hall requested that police follow him around in an undercover car.

He was told that one day in May police followed him to a podiatrist’s appointment, another appointment and a liquor store, while he was supposed to be working and had clocked in.

The NHS have revealed very poorly staff & employee attendance levels throughout it’s workforce, employee time tracking shows routine absenteeism is standard practise throughout the organisation. The entire workforce from Doctors to Porters show a reluctance to put in a full weeks work.

shutterstock_69160960NHS workers in England took an estimated 9.5 working days off sick last year, show the latest figures from the Health and Social Care Information Centre (HSCIC).

This equivalent figure in 2011-12 was 9.3 and 9.9 in 2009-10, the first year of reporting. But some staff groups have more days off sick than others, the figures show.

The findings, which cover about 1.05 million full time equivalent workers in the English NHS, excluding GPs and practice staff, are based on employee time tracking and applying the measured sickness absence rate to an assumed full time working pattern of 225 days a year.

These calculations show that ambulance staff took the most time off, clocking up 14.7 days in 2012-13, compared with 13.9 in 2011-12 and 14.4 in 2009-10.

Hospital doctors took the least time off sick, averaging 2.8 days, compared with 2.7 days in 2011-12 and 2009-10.

Nursing, midwifery, and health visiting staff took an average of 10.6 days in sick leave last year compared with 10.2 in 2011-12 and 10.9 in 2009-10.

Support and admin staff, which includes clerical, estates, and managerial staff, took an average of 8.4 days in sick leave, compared with 8.2 in 2011-12 and 8.8 in 2009-10.

The figures show that 4.24% of NHS staff were ill on any one day average day, compared with 4.12% in 2011-12 and 4.40% in 2009-10.

Some 6.55% of qualified ambulance staff were ill on an average day—the highest rate of any staff group, and the highest rate since 2009-10, when the equivalent figure reached 6.38%

Just 1.25% of hospital doctors were ill on an average day—the lowest rate of any staff group, but a rise on figures for the previous two years (1.19% in 2011-12 and 1.21% in 2009-10).

Regionally, sickness absence rates were highest in the North East where 4.74% of staff were ill on an average day, compared with 4.55% in 2011-12 and 4.98% in 2009-10. The lowest rate was in London at 3.52%, compared with 3.51% in 2011-12 and 3.64% in 2009-10.

Sickness absence was highest among the lowest paid. Six per cent of staff within the second lowest pay band (Agenda for Change Band 2) were ill on an average day– the highest rate of any pay band. The lowest rate was in the highest pay band (Band 9), with 1.22% ill on an average day.

Commenting on the figures, Sue Covill, director of employment services at the NHS Employers organisation, said that the protracted winter, organisational restructuring, and “challenging expectations” had all taken their toll, and were reflected in some of the figures published today.

Poor discipline is usually to blame, and there are probably plenty of employees willing to cover a shift if someone has not turned up.  Overtime within the NHS is probably a very important wage booster for the staff at the lower end of the pay scale.

shutterstock_31839181Andre Sneed, a former Harvey police officer, believes he was fired from the department after he raised concerns about payroll issues.

Authorities say two high-ranking Harvey police officers have been reassigned amid a Tribune investigation that found records showing them working for two communities during the same hours and getting paid by both.

The veteran officers each held full-time positions with the south suburban department while working security details that paid $19 to $25 an hour for two school districts, according to public records obtained by the newspaper.

The Tribune review found scores of unexplained inconsistencies in which the officers were reported on duty in Harvey during the same hours they were also getting paid to watch over school halls and sporting events miles away.

The records raise questions about why their bosses took so long to investigate. Harvey officials were tipped off to possible payroll discrepancies in 2011, yet they waited to take key steps to investigate the allegations until after the Tribune requested copies of time cards this summer.

The time cards for one of the officers, Cmdr. Roy Wells, 52, suggest he may have overlapped at least 200 hours since 2008, the equivalent of five full-time weeks of work. For example, on one day, he was paid for working 22 hours for the three agencies during one 24-hour period, the time cards show.

The other officer — Steven Porter, 52 — was Harvey’s senior police investigator in internal affairs, a role that made him one of the agency’s top ethics watchdogs. His time cards showed overlap of at least 120 hours since 2008, the equivalent of three full-time weeks.

Wells and Porter told the Tribune they were honest about their hours and suspect some of their time cards have mistaken entries.

Wells was paid $75,000 a year by Harvey and collected as much as $28,000 a year from the districts. He said there was “a very good explanation” for the discrepancies and that he expects to be vindicated.

Porter was paid $67,000 a year by Harvey and collected as much as $12,000 a year from the districts. Porter said he “acted appropriately” at all times.

“Look, I don’t cheat on my job,” Porter said. “I’m 28 years on the job. No way I’m going to throw away my career.”

Harvey police said they’ve contacted the Cook County State’s Attorney’s office about the suspected payroll irregularities. Prosecutors declined to comment.

Three places at once?

The Tribune obtained pay and timekeeping records for Wells and Porter from Harvey police, Rich Township High School District 227 and Homewood-Flossmoor High School District 233 through the open records act.

To allow for the possibility of small differences between the various employers’ time clocks, the newspaper’s review focused on dates in which someone clocked into a second job at least a half-hour before he clocked out of the first.

The analysis of the time cards from 2008 through May found that:

For Wells, there were at least 92 days when he was listed as working in two places at once. The average overlap was more than two hours each day. And there was an overlap in nearly one-third of all days he worked at a school.

On one day in early 2009, Wells’ time cards suggest he was in three places at one time.Records show he worked from 8:25 a.m. to 6:39 p.m. in Harvey, but started shifts at both high schools at 4:30 p.m.

The time cards said he worked until 6:30 p.m. at Rich Township, and until 10 p.m. at Homewood-Flossmoor.

For Porter, there were at least 101 days when time cards indicated he was in two places at once, with an average overlap of more than an hour. And there was an overlap in more than one-third of all days he worked at a school.

On a Tuesday in March 2010, time cards indicated he worked a full day at Harvey, clocking out at 5 p.m., but not before he started a 4 p.m. shift at Homewood-Flossmoor. That shift is shown lasting until 10 p.m., but he also started another shift at Rich Township at 6 p.m., which also lasted until 10 p.m., according to records.

Wells was asked about some discrepancies last year as part of a civil case. He said he sometimes worked in a Rich Township school for a few hours in the morning and then for a few hours later that same day.

Wells said Rich Township’s computer system required that he submit his hours as if he worked them all in a row. That could explain, he said, why his time cards would suggest a discrepancy when there wasn’t one.

The Simple Attendance Time Recorder Could Prove A Useful Ally.

In the event of disciplinary action being taken against an employee. Make sure you have hard evidence to back up your reason for doing so.

There may be occasions when employers have to take disciplinary action against employees in their absence but this carries legal risks.

The recent dismissal of Gus Poyet from his post as Manager of Brighton & Hove Albion Football Club live on BBC TV is a timely reminder for employers to beware when disciplining and dismissing an employee in their absence.

Communication by email, text message, social media, and instant messaging devices is now common and it is unsurprising that these methods are infiltrating the workplace.

Employers use a variety of methods to communicate with employees involved in a disciplinary process. In addition to the traditional use of recorded delivery letters, emails, text messages, and phone calls are often used to keep employees informed about the process.

Despite the various forms of communication available, however, many organisations are often faced with employees that are unwilling or unable to attend a disciplinary hearing.

What can an employer do when an employee fails to attend a hearing?

Employees often seek to avoid disciplinary hearings, perhaps in an attempt to put off the inevitable or through a desire to have more time to consider their position or because of the non-availability of their chosen companion.

The ACAS Code of Practice states that if an employee fails to attend a first meeting it will usually be good practice for the employer to re-arrange the meeting to an alternative day in order to give the employee a further chance to attend.

In the event that the employee persistently seeks to postpone the meeting or simply fails to attend without good reason, a decision may need to be taken in the employee’s absence. Employers can not be expected to put off a hearing indefinitely but the employee’s right to attend a hearing should not be dispensed with too hastily. Employers should always be wary of proceeding in an employee’s absence without very good cause, as the right to put forward one’s case at a disciplinary hearing is regarded by employment tribunals as the bedrock of a fair dismissal process.

Certainly employers should be very wary of proceeding to dismiss in an employee’s absence and should only do so having warned the employee that this is a possibility if they do not attend the meeting and having exhausted all options for getting some “buy-in” to the process from the employee. For example, inviting the employee to make written submissions even if they are not physically present at the meeting.

What if the failure to attend is because of ill health?

Often employers are faced with an employee unable to attend a disciplinary hearing by reason of ill health, commonly “stress” will be cited as the reason. Employees often think that by getting themselves signed off they can avoid disciplinary proceedings. The employer is then placed in a difficult position: on the one hand they need to ensure that the matter is dealt with speedily and fairly and on the other hand the employee must be given a genuine opportunity to attend the hearing.

Unless the employer feels that the problem will resolve itself in a short space of time it is good practice to consult an Occupational Health specialist with a view to obtaining a medical report on the employee’s fitness to participate in the meeting. While an employee may be unfit to do their job this does not necessarily mean they are unable to attend a meeting.

Occupational Health should be asked to comment upon whether the employee is fit to attend a disciplinary meeting. In particular the following questions should be considered:

  • Does the employee have the ability to understand the allegation;
  • Is the employee well enough to respond to the allegation;
  • Is the employee able to instruct a representative to assist them;
  • Does the employee have the ability to provide their explanation in writing?
  • Are there any adjustments to the disciplinary process which could be made to enable the employee to participate?

The employer could offer other alternatives such as a telephone hearing, a hearing at a neutral place or location near the employee’s home address, or even by inviting the employee to submit written representations.

In the event that Occupational Health advise that it is not possible for the employee to attend a meeting, the employer can still consider proceeding with a hearing in their absence on the basis that it is not appropriate to have the matter hanging over the employee’s head and that by concluding the process the employee will be assisted in recovering their health.

Obviously an employee would still be given the right to appeal the decision and a full hearing could then be held at that stage if requested. In circumstances where an employer has dismissed the employee in their absence, best advice dictates that a full re-hearing should be conducted on appeal so as to correct any procedural deficiencies in the initial decision.

Proceeding in the employee’s absence

Should the employer wish to proceed in the employee’s absence the hearing should still proceed and the disciplining officer should make a careful note of their deliberations and any questions asked of other witnesses or the investigating officer.

It is likely that an employment tribunal in any subsequent unfair dismissal case will require a detailed explanation of why the hearing went ahead without the employee present and what efforts the employer had made to secure the employee’s attendance and/or suggest alternatives to proceed in the employee’s absence.

Only in the clearest examples of the employee deliberately avoiding the hearing or malingering will the tribunal be minded to find in the employer’s favour. Employers should therefore only proceed where there is clear evidence that the employee is unreasonably refusing to attend the hearing.

Delivering a notice of dismissal

Caution should also be exercised when delivering the notice of dismissal to an employee who has not been physically present at the disciplinary meeting.

In Gisda Cyf v Barratt [2010] ICR 1475, a case in which a summary dismissal was communicated by letter, the Supreme Court held that the effective date of termination was when the employee actually read the letter informing her of her summary dismissal. Accordingly, in order to ensure that there is a clear record of when the dismissal was communicated it is good practice to ensure that any notice of dismissal is sent recorded delivery.

Further options include hand delivery of correspondence and/or delivery by email with appropriate read receipts being requested. The employer will then have a very clear record of when the notice of dismissal was communicated to the employee so as to avoid subsequent arguments about the effective date of termination for the purposes of the three month employment tribunal time limit starting to run.

Hmm, never mind that — I see you’re trying to take off your diaper and run around naked already, so let’s go ahead and get started with your review, shall we?

PART 1: PERFORMANCE

Knowledge, skills and abilities: You’re coming along nicely — you can feed yourself, you put on your own shoes, and you redo everything right after I’ve already done it, which is suuuuper helpful. However, there’s always room for improvement. For example, you still just stare at me blankly when I ask you to bring me a beer. As I’m sure I don’t need to remind you, upper management finds this unacceptable.

Quality of work: Be honest — you’re not even really trying to learn how to use the potty, am I right? And while the quantity of your Crayola masterpieces is impressive, I’d really prefer it if your portraits of me didn’t consist of huge, vigorously drawn circles followed by a declaration of, “BIIIIIIGGGG Mommy!”

Work habits: I’ll consider this a win if you ever let me rinse the “no tears” shampoo out of your hair without having a screaming hissy fit.

Communication: I’m impressed with your increased use of multi-syllable words, and it was a nice touch last week when you said, “Yuv you, Mommy” for the first time — that really brightened an otherwise ordinary Wednesday. But please, I’d like you to consider how much more effective our communication could be if you didn’t start 95 percent of your sentences with “No.” Also, I think we can agree that when I ask if your tummy is full, throwing pizza at my face probably isn’t the most professional response.

PART 2: BEHAVIOR

Dependability: Well, I can depend on you to kick me in the spleen just as I fall asleep, and you consistently refuse to eat any food that isn’t triangular. That’s a start.

Initiative: I’m going to rate you as Excellent here. If I so much as think the word o-u-t-s-i-d-e, you’re already crying because it’s taking me too long to open the door. You also frequently climb halfway up the stairs without having any reason to go up there, and you bring me pieces of dry food from the cat’s dish when I hadn’t even asked you to. Well done.

Punctuality/Attendance: This is one area in which you perform a little too well, so no need for an employee time recorder. shutterstock_24064375A Texas school district drew national attention, a lawsuit, and even cyber-attacks by Anonymous hackers with a pilot program requiring students to wear RFID tracking chips around campus. Now, after winning the lawsuit, surviving the denial-of-service attacks, and weathering the backlash, it has decided to drop the chips after all. But that doesn’t mean the privacy advocates have won.

Northside Independent School District spokesman Pascual Gonzalez told me that the microchip-ID program turned out not to be worth the trouble. Its main goal was to increase attendance by allowing staff to locate students who were on campus but didn’t show up for registration. That was supposed to lead to increased revenue. But student attendance at the two schools in question—a middle school and a high school—barely budged in the year that the policy was in place. And school staff found themselves wasting a lot of time trying to physically track down the missing students based on their RFID locators.

Andrea Hernandez, the student whose family unsuccessfully sued the district on religious grounds and referred to the IDs as “the mark of the beast,” is reportedly thrilled by the decision. She had ended up transferring to another school to avoid the IDs.

But the backlash and the lawsuit weren’t the deciding factors, Gonzalez told me. “While [privacy groups] are extolling the fact that they won, the fact is that that was a very minor part of our conversation, because the federal court and the court of appeals both upheld Northside’s position on that. We were on solid ground.”

The question of how much offline tracking is too much is also likely to arise in workplaces as employers use RFID tags to bust workers for, say, spending too much time in the bathroom.

ingersoll rand hand punchA 2009 ruling tasked the Ministry of the Interior with establishing a biometric identification system that will eventually replace the current picture ID system. The stated aim is to reduce cases of forgery and identity theft. The project has an initial two-year “pilot phase” in which citizens can participate voluntarily. The law is highly controversial here, drawing criticism from civil liberties organizations and security experts alike, who say the project is poorly managed and will lead to large-scale leaks and theft of personal data.

The pilot was hindered by numerous delays over the rising public outcry, several appeals to the Supreme Court and even a labor dispute. The pilot phase was originally set to begin in 2010; it was recently announced that the phase is now scheduled to start in two weeks. Over the next few days an ad campaign will try and convince citizens to hand over their biometric identification in exchange for a new, high-tech ID card.

The pilot phase will conclude by June 2015. The government then has the option to end the experiment and destroy the database – or order that all citizens be issued a national biometric ID. During the pilot phase, old ID cards will still be issued.

The existence of a preliminary pilot program itself came under criticism, with detractors saying that it was created to only to placate the opposition and that it lacks clearly defined goals.

What is a biometric ID?

Old, low-tech IDs contain easy-to-forge information: names, addresses and a unique ID number printed on a card along with a picture. A national database that links names to ID numbers exists, but law officers have no way to know if the card and the picture within are authentic. With a low-tech ID system, identity theft is relatively easy, especially in a world full of high-resolution digital cameras, image-manipulation software and home printers.

A biometric ID is notably harder to fake. The data it relies on is those physical traits that are unique to each person and difficult or impossible to change, such as fingerprints or retina scans. The two identifiers chosen in Israel are fingerprints and facial contour information that remains unchanged even if cosmetic changes are applied.

This is the first attempt to create a national database in Israel, but several biometric identification systems are already in place here. One is a fingerprint-ID system that allows jobs seekers to report to employment service offices without waiting in line. Another system is operated by the Airports Authority that enables card holders to skip passport control. Participation in both systems is voluntary. Many private employers also require biometric identification systems to control access to workplaces or as cheat-proof time clocks.

How will it work?

A person wishing to join the database can report to an office of the Population and Immigration Authority with a valid ID card, a passport or a travel document. A PIA officer will validate your identity with several computer-chosen questions drawn from the Interior Ministry’s databases. You will sign a release authorizing the PIA to collect and store biometric data. An electronic scanner will take fingerprints from two fingers and a specialized camera will scan faces for a personal “facial ID.”

The data will be stored in a specialized database, separate from the PIA’s databases, which will be operated by a separate agency. Law officers and others authorized to check biometric IDs will be equipped with portable terminals which won’t give them direct access to personal data – only allow to ascertain the identity of a card’s holder.

Will I have to carry such an ID?

Israeli law mandates that citizens carry their ID card with them at all times (in reality, the law is seldom enforced). When the pilot is completed, and if the initiative isn’t scrapped in this phase, the biometric ID will be the only type of ID issued.

Will my information be safe from theft?

Experts have expressed strong concern over the security of the new system, concern that mounted as time went by. They cite the state’s abysmal record in keeping private information safe, as well as multiple hiccups in the project’s creation. As the pilot phase draws nearer it becomes clear that two key requests for tender – one for the supply of an anti-forgery system, the other for the position of data security analyst – will not be filled in time.

Two organizations, whose appeals to the Supreme Court to scrap the project have been denied, have issued harsh statements on Tuesday. The Association for Civil Rights in Israel has said that keeping a database is not necessary for issuing biometric ID cards and warned about the “irreversible” implications of a leak from such a database. The ACRI has also warned that the database will become a data-gathering tool for the police.  More here..

shutterstock_31633483Jason France, of Baton Rouge, says he tried to prevent the state Department of Education from turning over sensitive information about his daughter to a national database.

“The data may not be correct; that is one problem,” France said.

“What happens if your kids’ information is incorrect and it is negative?” he added. “You would never be able to fix it. That is one of the unintended consequences.”

The data sharing was touted by state Superintendent of Education John White and others as a way to aid teachers.

But concerns by France and other parents have already helped spark the cancellation of the state’s contract with a group called inBloom, which is supported in part by the Bill & Melinda Gates Foundation.

Now the state is launching a task force to try to find ways to balance school needs with rising concerns about privacy, especially amid concerns that students could be traumatized, or worse, if delicate information falls into the wrong hands.

Schools and school districts have long collected information about students, including Social Security numbers, ethnicity, date of birth, family income indicators, medical issues, attendance and other information.

The dispute is whether the benefits of the data sharing are outweighed by the risks that the data will fall into the hands of employers, for-profit firms and even hackers.

“This is totally irresponsible,” said Deborah Sachs, who lives in Mandeville.

The Sachs family has asked the state and St. Tammany Parish school system officials not to share information about their daughter Rachael Sachs, a 16-year-old student at Mandeville High School. That includes name, date of birth, Social Security number, pictures and health information.

Rachael Sachs made an appeal to the state Board of Elementary and Secondary Education last month. “I want you to understand that what may seem inconsequential to adults could be devastating to teenagers,” she said.

White, while backing the task force, generally has downplayed worries by France and others, including charges that he has failed to take the steps needed to cancel the state’s agreement with inBloom.

He told BESE that the state takes elaborate steps to keep the student data private, including digital firewalls, private “tunnels” between the state and local school districts when information is shared, and encryption methods to prevent data from being intercepted.

InBloom officials say it brings together data, content and tools educators need for personalized learning, and does so with an emphasis on the security of the data.

White said the dispute arose because, if the state is compiling information about students, should it be available to help teachers?

Jim Garvey, vice president of the state Board of Elementary and Secondary Education, represents St. Tammany Parish and other areas where parents are voicing concerns.

How does cashless catering work? – Cards

Accounts are set up on the catering system for each student and swipe cards issued out to everyone.

Parents/carers then need to send in cheques (cash is accepted at some schools) and the amounts are credited to the appropriate account. Some schools have also introduced the ability to credit their child’s account through secure internet payments.

Students will then be able to use the catering facilities as normal – select the items they wish to purchase and take them to the till. The cost of the items are registered on the till and the swipe card handed over for payment. As the card is swiped through the till, the amount due for the purchases is debited from the student’s account.

Students can check the amount of money remaining on their account and daily spend limits can be set by parents to ensure that not all the money credited to the account is used in a few days.

The money is held on the system and not on the card, so if a student loses their card, they do not lose their money.  If a card is lost, the student must report this to the school office as soon as possible so a replacement can be arranged. There may be a small charge for this.

For students who are entitled to free meals, this system allows them to purchase a meal in exactly the same way as every other student. The standard meal cost will be added to a free meal student’s account each day to ensure they are able to spend that amount at lunch time.

These students can also top up the money available on their account by paying in cheques or cash for purchase of items at break times for example.

How does cashless catering work? – Biometric

Exactly the same system as the Card Accounts detailed above, but instead of a card the system used a biometric scan of each pupil’s finger. Often wrongly though of as a “fingerprint” the scan converts the image of the finger into a biometric logarithm and then deletes the image. ~At each till point, and any cash revaluers with scanners attached, the pupil simply places the correct finger on the scanner to bring up their account.

shutterstock_52548088 Parents who break school attendance rules and holiday during term time are saving themselves up to £1,000 a trip, according to new research. Despite the fact that many schools routinely impose £50 fines on “unauthorised absences”, which would include family holidays, the cost of this won’t outweigh the savings to be made in many cases. The research by Nationwide Building Society found that 37pc of parents admitted that they had taken their children out of school to get a good deal on a holiday.

On a trip to Euro Disney the cost was almost £400 more expense for a family of four; on a package trip to Spain the cost rose by more than £1,000 – almost half the cost of the holiday.

A number of local authorities now authorise schools to charge a £50 daily penalty on each parent. So on a family of four, this would equate to a £200 daily penalty – (£50 per child, per parent), effectively wiping out any savings made on their holiday. The following, from Camden Council in north London, is the typical message addressed to parents tempted to get away ahead of the holiday price-hikes: “We strongly advise parents not to take leave in term time. There is no automatic right to leave and parents should not assume that a head teacher will agree a request for leave.

If the head teacher does not agree the leave we will support the school’s view and we will not overrule the head teacher’s decision.” It added: “Please note, parents may be asked for medical evidence if your child is absent the week before or after a school holiday.

Fingerprint Clocking In Systems and The General Use Of Biometrics To Monitor Employees, Is Still Causing Controversy In The City

Employee Monitoring: McCague Borlack, Toronto Law Firm, Aims To Fingerprint Non-Lawyer Staff

fingerprint clocking in systemA group of legal secretaries at a Toronto corporate law firm is rebelling online against a plan that would see them fingerprinted when they come and go at work.

McCague Borlack LLP, a law firm that specializes in banking and insurance litigation, is planning to implement fingerprint reading technology at its offices this month, to address complaints about employees who were taking excessively long lunch breaks or cutting out early from work. The new system will not apply to the company’s lawyers, only its administrative staff.

Some people were abusing the system,” founding partner Howard Borlack told theToronto Star. “We had people taking two to three hours for lunch and we had no way of knowing. . . . Some people were complaining.”

He said the primary purpose of the new system was to improve building security, but being able to track workers is “a huge bonus.”

Employees of the firm have evidently launched a website, called Which Finger to Give to Bay Street, to protest the move.

“Life is good for the lawyers at the firm; their money keeps rolling in at $400/hr. Often at a higher rate! Their secretaries are not so lucky. Secretaries at this firm earn 20 times less than these fancy Bay Street Lawyers. And secretaries are treated with the following degrading contempt: a finger printing program!” the website states.

I suspect that the vast majority of workers will find forced fingerprinting by their employer to be offensive. Certainly, [I] suspect highly qualified legal secretaries won’t be rushing to come work at this firm now,” York University labour professor David Doorey wrote on his blog.

Doorey notes that fingerprinting workers could violate work contracts if those work contracts stipulate some measure of privacy. But he suggested legal recourse could be sparse for the employees.

A fire routine is based on a critical sequence of events, here is an example for a School:

Fire alarm operation

Anyone discovering an outbreak of fire must, without hesitation, sound the fire alarm by actuating the nearest fire alarm call point.

Calling the Fire Brigade

All outbreaks of fire or any suspected fire, however small, should be reported immediately to the Fire Brigade by the quickest means available, by calling 999. This task could well be designated as the responsibility of the school secretary as a telephone will be readily available at that location.

Evacuation:

  • Hearing the fire alarm, pupils must be instructed to leave the building in single file and in a calm, orderly manner
  • The person in charge of each class must indicate the exit route to be used and everyone must be directed to a Predetermined Fire Assembly Point
  • Specific arrangements must be made for pupils with physical or mental disabilities to ensure that they are assisted during evacuation
  • No running is to be permitted to avoid panic
  • On staircases everyone must descend in single file. Overtaking of classes or individuals must not be permitted
  • Lifts must not be used
  • Anyone who is not in class when the fire alarm sounds must go immediately to the fire assembly point
  • No one must be allowed to re-enter the building until told to do so by the Fire Service in attendance, or, in the case of a fire evacuation drill the senior person in charge

Fire Assembly Point

  • An area outside the school premises must be designated as a fire assembly point
  • It must be clearly marked and easily identified by any person who must be expected to be in the school premises
  • The fire assembly point must be far enough away from the school premises to afford protection from the heat and smoke in a fire situation at least 10 metres away from any building
  • The fire assembly point must be in a position that does not put pupils and staff at risk by emergency vehicles responding to the incident

Fire Roll Call

  • One person should be nominated as the fire marshal who will have overall control and responsibility during the evacuation. The fire marshal will ensure that a roll call is conducted in the event of evacuation of the premises
  • Immediately after classes have assembled at the fire assembly point, a roll call or count must be made to ascertain that no one remains unaccounted for
  • Any visitors or contractors in the premises at that time must be included
  • The count at the assembly point must be checked with the attendance registers and visitors book to verify that everyone is out of the building

  • Clear passage to all escape routes in the event of a fire or emergency.
  • You have to ensure that these escape routes are as short as possible enabling quick escape and are also clearly marked up.

  • The emergency doors must be easy to open and have enough lighting.

The Media Hype Against Finger Print School Attendance Registration, Cashless Vending and Biometric Class Registration Systems Continues.

Biometrics and the recording and storing of School Children’s fingerprints for attendance and class registration, continues to irritate  campaigners against state surveillance. It’s Orwellian implications still haunt a lot of people who are fearful of having their every move scrutinised and recorded.  And to be honest we all like our privacy, but should we be fearful of finger printing school pupils for attendance and class registration, after all pupils have the choice to opt out of the biometric registration process, and can be issued with a plastic card instead.

So whats the problem?

Summary

Biometrics come in many forms, facial recognition, hand geometry, fingerprint scanners – the correct introduction and education of how these systems work is important, if you are to overcome peoples natural reluctance and prejudices to have their biometric data held in a database.

This decision gave Britain the accolade of being the first country in the world to commercially market biometric technology to UK schools.

In the UK, schools hold masses of data about our children.  They are one of the most surveilled school populations in the world, not only in the subjects they study, their health and eating habits, but also through the use of biometrics and location RFID tagging.

Between 2001 and 2012, biometric systems in education were initially used for library systems in primary and secondary schools. By 2006 biometrics were increasingly used for cashless catering, school lockers, school trip money payments and registration.

In 2005, privacy organisations and parents concerned about the use of biometrics in schools began lobbying Parliament, with a particular focus on the fact that schools were taking children’s biometrics without informing parents.

A person’s biometric data does not fall under Part 2 of the Data Protection Act (DPA), Sensitive Personal Data. There is obviously a lot of  mis-information and hysteria, surrounding the use of biometric fingerprint systems for class/attendance registration and cashless catering. An increase in the implementation biometrics in school attendance is on the cards.

The children themselves from our experience have no problem with the idea of biometrics and are not techno phobic like some of the teachers and parents can be.

American firm the Yankee Candle Co have chosen local Company Facetime Ltd, as suppliers for their new time attendance system for their new national distribution centre.

Loyal staff and employees burnt the candle at both ends, in their attempt to hit the deadline for the move from their old Warehouse site at Almondsbury North Bristol, to their brand new  170,000 sq ft Warehouse.

Facetime Ltd have supplied and maintained time attendance systems for Yankee Candle for over 15 years at their old site in Almondsbury.
